How my lawyer turned against me

I would call up Lawyer Phil and ask
him if he wanted to invest.
Phil had a 401K and he was always looking
for a note to buy or something to invest
in, usually at a high interest rate.
I also used Phil for some of my legal
work so he not only invested in my deals
but he helped me stay out of trouble.
One day I had some major hassle with this
guy who was trying to take one of my
properties away from me.
It was ugly.
And ran up a huge amount of billies
(billable hours) with Phil.
I got Phil's bill one day and I about
fell off my chair.
It was a fraction of what I had expected
it to be.
Don't get me wrong -- I was delighted at
first.
Then I went through it carefully and I
had but one conclusion.
Phil had completely mis billed me.
So here was my choice:
1. Bring it up to Phil, or
2. Not say anything and pay the bill that
was like only 10% of what it should be.
Keep in mind Phil wasn't cheap, no not
at all. Like at the time $300 an hour
(and this is going back a few years, quite
a few years.)
Phil was EXPENSIVE.
So I was tempted and I did what most
normal people would do in that situation.
Expensive attorney.
Billing error in your favor.
Keep your mouth shut...
Maybe a year later I got a call from Phil.
I had gone through some business reversals
and things were not good with the Gell-Dog.
Phil calls me, and I remember I was in a
meeting with some venture capitalists
pitching something new, and he calls me and
I get the call there and I talk to him.
And he tells me pleasantly enough that he
has to get his money or else he will have
to sue me for his fees.
"And if you hadn't said anything about that
bill being all wrong, I never would have
caught it. My assistant made this huge
mistake but thank you for pointing it out."
Okay, so I did the right thing and the
moment I got that bill months before, I called
him and told him it was wrong.
And months later when he told me he had to
collect I found the money and paid him.
I had no regrets. I did the only thing
I could have to feel right about myself.
I miss Phil.
He retired and used that big
fat 401K and hopefully is still living off
of it.
Have you ever pointed out a billing mistake
that went against you and then been
sued for that amount?
(I wasn't actually sued but he threatened
to and would have.)
I have no regrets. Pointing out the mistake
was the right thing to do.
